Right of withdrawal

RETURNS AND RIGHT OF WITHDRAWAL

In the case of a Contract for the purchase of Products and Services concluded by a Consumer Customer, the latter shall have the right to withdraw from the Contract, pursuant to and for the purposes of Article 64 et seq. of the Consumer Code, without any penalty and without specifying the reason.

The decision to exercise the right of withdrawal must be communicated by the Consumer Customer by sending a registered letter with acknowledgement of receipt within 14 (fourteen) Working Days of receipt of the Product by the Consumer Customer to the following address:

The right of withdrawal shall also be deemed to have been validly exercised if the Consumer Customer sends, within the aforementioned period, a notice of withdrawal by fax (to 091/453983), by email (info@cibafil.com), by registered letter or by following the guided procedure on the website www.cibafil.com (My account / History and details of my orders / Details / flag the products to be returned / click on ‘Return Products’.Upon receipt of the notice of withdrawal:

  1. The return authorisation number will be sent to the Customer by e-mail. This number must be included inside the envelope containing the Product to be returned.
  2. the Product must be intact in all its parts;
  3. the Product must be returned within 14 working days of receipt to the address indicated above.

The right of withdrawal applies exclusively to goods that are intact at the time of return, in accordance with the provisions of Article 67, paragraph 2 of the Consumer Code.
If, on the other hand, the procedures, conditions and terms for exercising the right of withdrawal, as specified in this article, are not complied with, the Consumer Customer will not be entitled to a refund of the sums already paid. In this case, the Consumer Customer may, at their own expense, recover the Product in the condition in which it was returned to Cibafil. Otherwise, Cibafil may retain the returned Products, in addition to all sums already paid by the Consumer Customer for the related purchase. Shipping and transport costs shall be borne by the Customer.

For the sake of completeness, the Consumer Customer may not exercise the right of withdrawal in question if one of the cases of exclusion of the right of withdrawal provided for in Article 55, paragraph 2, of the Consumer Code applies.

Finally, if the information obligations referred to in Articles 52, paragraph 1, letters f) and g), and 53 of the Consumer Code have not been fulfilled, the deadline for exercising the right of withdrawal is ninety days and starts from the day of receipt of the Products by the Consumer Customer.

Timeframes and methods for reimbursement following the exercise of the right of withdrawal

After the Product has been returned, Cibafil will carry out all the checks and verifications referred to in the previous paragraph. If the checks are successful, Cibafil will send the Consumer Customer, by email, confirmation of acceptance of the returned Product and, within 14 (fourteen) days from the date on which Cibafil became aware of the Consumer Customer's exercise of the right of withdrawal, a refund of the sums already paid by the latter for the purchase of the Product.

If there is no correspondence between the recipient of the Products indicated in the Purchase Order and the person who made the relevant payment, in the event of the Consumer Customer exercising their right of withdrawal, the refund of the sums will be made by Cibafil, in any case, to the person who made the relevant payment.
